How do we deal with a case in which the younger sister disregards family ethics and breaches her promise in order to take possession of their father's estate? Recently, the judgment was pronounced in the second trial of a will succession case represented by lawyers Sainan Ma and Zhengliang Ren of Jiali Law Firm. Although the other party determined that their father's final will was invalid and attempted to dominate the estate in accordance with the first will, with the efforts of the two lawyers, the court's final decision adopted the second will and judged that the client Mr. Li shall receive a 25% share of his father's estate.
Mr. Li's father made a will many years ago. According to the contents of the will, an amount of real estate and all his belongings were to be inherited by his sister. A few years later, his father made a new will before his death. According to the contents of the new will, his father treated Mr. Li and his sister equally and stated that his real estate assets were to be jointly shared between them.
During the litigation process, in order to monopolise the estate, Mr. Li ’s sister first proposed that her mother was unaware of the final will written by her father, then stated that the second will was a will to be inherited conditionally, and Mr. Li had not fulfilled his supporting obligations.
In response, Lawyer Ma submitted a large amount of evidence such as videos and certificates to prove that Mr. Li's mother knew about and agreed to his father's final will. She also found key video evidence to certify the facts of the case. As for the claim that the second will was made conditionally and Mr. Li had not fulfilled his supporting obligations for meeting the conditions of the inheritance, Lawyer Ma said in court that Mr. Li had fulfilled his supporting obligations, and the focus of the dispute in this case was the inheritance of his father's estate, which meant that all inheritance shall be based on his father's wishes. Therefore, Mr. Li and his sister should be treated equally. Finally, the court accepted Lawyer Ma's opinion.
Lawyer Sainan Ma has been practising law for over 10 years, focusing on the research and handling of marriage and family matters. On November 6th, 2019, Mr. Li specially came to Jiali Law Firm and presented a banner with the words “Exquisite Business with Sincerity and Reliability” to lawyers Sainan Ma and Zhengliang Ren.
