On the afternoon of September 23rd, Ms. Shen came to Jiali Law Firm and presented Lawyers Lili Miao and Ainan Geng with a banner reading, ‘Excellent and Trustworthy’.

It is known that Ms. Shen’s husband had multiple extramarital affairs when they were married. In order to keep the family together for their child, Ms. Shen suffered for many years. In April this year, there was another fierce conflict between Ms. Shen and her husband. She could no longer bear it and decided to divorce. Her husband agreed to a divorce, but both parties were reluctant to give up custody of their child, and could not agree on the division of a house purchased while they were married.

After accepting the entrustment, Lili Miao and Ainan Geng had a lengthy conversation with Ms. Shen in which they learned that Ms. Shen and her parents had taken care of her 9-year-old child since birth, and the child had clearly expressed a preference to live with Ms. Shen. Besides, the house in question was purchased while they were married, Ms. Shen’s parents accounted for 85% of the investment, and the house was registered in Ms. Shen’s name.

In this case, although Ms. Shen’s parents paid the largest share for the house and it was registered under her name, the house was purchased when they were married and thus involved loan repayment. Ms. Shen’s parents’ contribution could be recognised as a gift or a debt, or even as a one-time gift to Ms. Shen from her parents. Based on the principle of maximising profits, the two lawyers conducted an extensive investigation of the fundraising situation of Ms. Shen’s parents, and also conducted detailed investigations into other properties owned by Ms. Shen’s husband.

After the above investigations, based on a small clue provided by Ms. Shen, the two lawyers succeeded in finding a house inherited by the husband while they were married which was not previously known to Ms. Shen. In court, Lawyer Lili Miao directly produced the ‘inheritance agreement’ signed by the man to inherit the house, taking him by surprise.

Considering Ms. Shen’s desire to divorce as soon as possible, Lili Miao and Ainan Geng developed the best mediation plan for Ms. Shen while actively responding to the legal proceedings, and made full use of their negotiation skills to promote the progress of the mediation. Through their unremitting efforts, the case was successfully mediated: Ms. Shen retained custody of the child and gained full possession of the disputed house. The superb skills and professionalism demonstrated by the two lawyers in handling the case were recognised and praised by Ms. Shen and her family. After receiving the mediation agreement, Ms. Shen had a banner specially made for the two lawyers to express her gratitude.

Lili Miao works in a rigorous manner and formulates winning strategies. She is skilled at centralising her resources to focus on the key problems, then find the weak points of the counterparty and attack them in court. With strong empathy, Lawyer Geng is an excellent communicator who is skilled at handling relations between clients, judges and lawyers in order to accelerate the process of the whole case. There is never small case among family cases, and Jiali lawyers are dedicated to helping every client gain the most benefits.
