On the morning of June 19th, Mr. Zhou and his mother came to Jiali Law Firm and presented Lawyer Yi Yi with a banner reading, “Expert and Professional in Legal Services, Righteous and Dedicated to Serving Clients” to express their gratitude to Lawyer Yi and Auxiliary Counsel Wang Jingyu for their professional and patient legal services and help in handling the case.
Mr. Zhou was a party to a divorce case represented by Lawyer Yi Yi. Mr. Zhou and his wife had been married for over a decade. Their child had been cared for by Zhou’s parents from birth. Yet Mr. Zhou’s wife had problems with his mother due to different philosophies regarding parenting and a range of trivial matters. In June 2018, the wife and mother had another dispute, after which the wife left home on that day and filed a divorce lawsuit.
Just three days before the first court session, Mr. Zhou and his mother came to Jiali Law Firm. After accepting the entrustment, Lawyer Yi Yi and Auxiliary Counsel Wang Jingyu immediately reviewed the background of the case. The dispute between the two parties mainly concerned the ownership of a house and custody of their 8-year-old child. After marrying, Mr. Zhou had purchased a house with money from his mother, cousin and himself. That house was registered under the name of Mr. Zhou. His wife now required him to divide the house in their divorce.
This being an urgent task, Lawyer Yi worked overtime with her team on the investigation and collection of evidence. They carefully reviewed the bank statements of Mr. Zhou, his mother and his cousin, and also checked the deed to the house, contract of purchase and other related materials. The evidence was adequate and comprehensive.
After extensive communication with Mr. Zhou and his family, Lawyer Yi learned that Mr. Zhou was not sure whether he wanted to agree to the divorce. As such, Yi prepared two trial strategies. She had sufficient evidence to help Mr. Zhou retain ownership of the house and seek custody of the child regardless of whether or not he agreed to the divorce in court.
Faced with sufficient and comprehensive evidence, the counterparty was unable to justify themselves in court, as a result of which the wife requested mediation afterwards. With Mr. Zhou in an advantageous position regarding the lawsuit, Lawyer Yi elaborated to him and his family on the pros and cons of going forward with the lawsuit or choosing mediation. Finally, Mr. Zhou decided to reach a mediation agreement with his wife in which he would be responsible for raising the child, and ownership of the disputed house would go to him.
Mr. Zhou and his family were quite satisfied with the results. After receiving the mediation agreement, they had a banner made to thank Lawyer Yi and Auxiliary Counsel Wang for their efforts which resolved the divorce dispute successfully and effectively.
