Three Daughters and One Son have Difficulty Supporting the Elderly – Lawyer Lili Miao Awarded a Banner for Achieving All the Client’s Claims

\

In a dispute over supporting the elderly, four judges were replaced before and after, and the interference and procedural obstacles of the parties cost more than 400 days. Recently, with the unremitting efforts of Lawyer Lili Miao and Auxiliary Counsel Jingyu Wang of Jiali Law Firm, the case was successfully concluded, and Mr. Zhu was able to solve the problem of supporting his mother in her 90s. All other claims were also sustained.

Mr. Zhu has three sisters. After the death of his father, his mother suffered from mental illness and lived with Mr. Zhu. His family failed to hire a nanny because his mother did not allow outsiders to get close, and the responsibility to support his mother fell to Mr. and Mrs. Zhu. During this period, his sisters did not fulfil their supporting obligations, and the eldest and youngest sisters hardly visited their mother. Mr. Zhu had no choice but to file a lawsuit against his sisters requiring the four siblings to take turns supporting their mother.

The process of handling this case was tortuous, and many special procedures were experienced before the supporting disputes. During the entire litigation process, Lawyer Lili Miao and Auxiliary Counsel Jingyu Wang learned that there was a serious lack of mutual trust and communication among Mr. Zhu and his siblings. Since Mr. Zhu's claim was for the siblings to take turns supporting their mother rather than for economic benefits, the trial could be completed once started, but it was challenging to meet the parties’ demands.

To this end, Lawyer Miao repeatedly communicated with the judge and the other parties by phone and contacted the neighbourhood committee. Under the organisation of the judge, the parties' hidden scars were finally healed after many trials and mediations. During this period, the judge handling the case had become "entangled" in guardianship qualifications and litigation status. Lawyer Miao wrote and submitted a genuine Personal Proposal detailing the urgent need of Mr. Zhu's mother for the support and companionship of her children.

After the efforts of Lawyer Lili Miao and Auxiliary Counsel Jingyu Wang, the court finally ruled that the four siblings shall support their mother in turn, with each of them taking care of their mother for one week. In order to thank Lawyer Miao for her dedication and responsibility for more than a year, Mr. Zhu had a banner specially made for Lawyer Miao after receiving the judgment.

Lawyer Lili Miao is a senior lawyer in the Case Management Department of Jiali Law Firm. She is meticulous in thinking, unafraid of danger, calm and resourceful. She has extraordinary perseverance and can devote 100% of efforts for 1% of hope. In this case, Lawyer Miao stated that supporting cases involved not only disputes over interests but also family disputes between parents, children and brothers. In the face of elderly parents, there are always some children who try every means and method to escape their responsibilities. When they are young, they enjoy the support of their parents, so they should support their parents when they grow up. This is a responsibility and also an obligation. Cherish the time you can spend with your parents, and don't regret it when "Sometimes parents pass away before their children have a chance to repay"!
